2012 "The L Bar Cruise for Love" Contest Rules
1.CONTEST OVERVIEW
The object of this Contest is to award the Grand Prize of a sponsored 4-day/3-night Carnival Cruise to Cozumel, Mexico from New Orleans, LA for the Winner and 3 companions of his/her choice, as further described herein (the Contest). No other compensation will be provided. Winner responsible for airfare, port charges and taxes.
2.SPONSOR
Thel-bar.com, LLC., 4520 S Sherwood Forest Blvd., Suite 104403, Baton Rouge, LA 70816, U.S.A, (USA Sponsor or The L Bar).
3.BINDING AGREEMENT
In order to enter the Contest, you must agree to these Official Rules (Rules). Therefore, please read these Rules prior to entering to guarantee that you understand and agree. You agree that submission of an Entry in the Contest constitutes agreement to these Rules. You may not submit an Entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and The L Bar with respect to the Contest.

4.TERM
The 2012 The L Bar Cruise for Love Contest begins December 1, 2011 at 00:00:00 p.m. U.S. Central Time (CST) (the Contest Period). Information on how to enter and prizes form part of these official rules (Official Rules). By scheduling an adult romance party using The L Bar's online scheduling system at http://www.thel-bar.com/#!__host-a-party-contest/schedule-a-party, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules.
WHO MAY ENTER
Contest is open only to individuals living in the Domestic U.S. who have reached the age of majority in their jurisdiction of residence at the time of entry and who do NOT reside in a jurisdiction, in which this type of contest is prohibited. Employees of The L Bar, and its subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not related, are NOT eligible. CONTEST IS VOID IN ANY JURISDICTION WHERE PROHIBITED. The L Bar reserves the right to verify all eligibility requirements. Contest is subject to all applicable federal, state and local laws and regulations.
5.HOW TO ENTER
5.1.To enter the Contest, visit The L Bar website at www.thel-bar.com and schedule to host an adult romance party. Hostess must be 21 or older to host a party. Party total sales must reach $750 or more to be eligible for entry. Party requests are only accepted where permissable by law.
5.2. We will only accept one [1] Entry per person. Additional entries in excess of [1] by the same entrant will be disqualified. All romance parties hosted must be held by by May 31, 2012 at 23:59:59 p.m. CST.
5.3. Automatic entry to the Contest requires entrants to host an adult romance party executed by one of The L Bar's Inddependent Consultants also referred to as Bartenders. Party sales must total $750 or more to qualify for Contest entry.
6.WINNER SELECTION
6.1.The winner will be selected by a drawing on June 11, 2012.
6.2.In the event that the selected winner of any prize is ineligible, cannot be traced or does/do not respond within ten (10) days to a winner notification as required by these Official Rules above, or refuses the prize, the prize will be forfeited and The L Bar, in its sole discretion, may choose whether to award the prize to another entrant.
6.3.Winner's name will be available online at http://www.facebook.com/thelbar after June 11, 2012.
7.CONTEST PRIZE
7.1.The Winner will be entitled to receive a 4-day/3-night Carnival Cruise to Cozumel, Mexico from the Port of New Orleans, LA. The contest does not include air airfare nor port charges/taxes. Winner responsible for all port charges/taxes and airfare.
7.2.The potential Winner shall be required to sign and return within ten (10) days following an attempted notification, an Affidavit, Declaration or Certificate of Eligibility, Liability Release, and where legally permissible, a Publicity Release and Warranty of Ownership and License in which the entrant warrants that he/she is the owner of the photograph (and all the intellectual property rights in the photograph submitted) and grants to The L Bar and its licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the Entry (along with a name credit) in connection with the Contest and promotion of the Contest WITHOUT additional compensation. Failure to execute and deliver any required documents to The L Bar by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner.
7.3.No prize transfer, assignment, or substitution by winner permitted. If a prize (or part of a prize) is unavailable, The L Bar, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law and provided that no cash alternative is available. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY EMAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATE POTENTIAL WINNER.
8.TAXES
THE GRANT OF PRIZE TO POTENTIAL WINNER IS SUBJECT TO THE EXPRESS REQUIREMENT THAT SUCH WINNER SUBMITS TO THE L BAR ALL DOCUMENTATION REQUESTED BY THE L BAR TO PERMIT IT TO COMPLY WITH ALL APPLICABLE U.S., STATE, LOCAL AND FOREIGN (INCLUDING PROVINCIAL) TAX REPORTING AND WITHHOLDING REQUIREMENTS. ALL PRIZES WILL BE NET OF ANY TAXES THE L BAR IS REQUIRED BY LAW TO WITHHOLD. ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. In order to receive a prize, potential winner must submit the tax documentation requested by The L Bar or otherwise required by applicable law, to The L Bar or the relevant tax authority, all as determined by applicable law, including, where relevant, the law of the potential winners country of residence. The potential winner and his/her parent or legal guardian are responsible for ensuring that (s)he complies with all the applicable tax laws and filing requirements. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and The L Bar may, in its sole discretion, select an alternative potential winner.
9. LICENSE
By entering the Contest, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Authorized Parties, to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including, but not limited to: Display at a potential exhibition of winners; publication of a book featuring select entries in the Contest; publication on www.thel-bar.com or via any other media. Entrants consent to The L Bar doing or omitting to do any act that would otherwise infringe the entrants moral rights in their entries. Display or publication of any entry on an Authorized Party's website does not indicate the entrant will be selected as a winner. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made in connection with the Contest, and pictures or likenesses of Contest entrants, or choose not to do so, at their sole discretion. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.
10.LIMITATION OF LIABILITY
10.1.By entering this Contest, all entrants agree to release, discharge, and hold harmless The L Bar and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives (the "Released Parties"), from any claims, losses, and damages arising out of their participation in this Contest, including, without limitation, a third partys claim or demand relating to such entrant's Entry, or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.
10.2.Subject to any applicable law, The L Bar assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. The L Bar is not responsible for any problems or technical malfunctions of computer online systems, servers, access providers, computer equipment, software or any e-mail, online or internet entry lost due to technical problems or traffic congestion on the internet or at any website or any combination thereof, including any injury or damage to an entrant's or any other person's computer or property related to or resulting from playing.
10.3.ALL PRIZES ARE GIVEN AWAY BY THE L BAR "AS IS." SPONSOR DOES NOT MAKE AND HEREBY DISCLAIMS ANY WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY (INCLUDING WITHOUT LIMITATION IMPLIED AND STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NONINFRINGEMENT, WITH REGARD TO ANY PRIZE(S) OR PORTION(S) THEREOF.
11.CONDITIONS
THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of Louisiana, United States of America and the forum for any dispute shall be in the Louisiana, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if The L Bar determines hosted party(ies) to be fraudulent, or if the Entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.
By entering, entrants also agree (a) to be bound by these Official Rules; and (b) that the decisions of The L Bar and/or Judges (as applicable) are final and binding with respect to all matters relating to the Contest.
13.RIGHT TO CANCEL OR SUSPEND CONTEST
If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, The L Bar reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If The L Bar elects to cancel or terminate the Contest, The L Bar will not retain any rights in the submitted photographs, and will return the fees submitted with each entry.
14.DATA PRIVACY
Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules, all in accordance with The L Bar's Privacy Policy located at http://www.thel-bar.com/#!privacy. The data may also be used by The L Bar in order to verify the participant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the Contest. Participants have the right to access, review, rectify, or cancel any personal data held by The L Bar by writing via email to: thel-bar_thel-bar.com.
REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by The L Bar to mail skill contests or sweepstakes. To elect to have an individual's name excluded from all such lists, submit a removal request in writing to: thel-bar_thel-bar.com. This notification system may be used to prohibit mailing of all skill contests or sweepstakes by The L Bar to such individual.
